Start Now — $350 Flat FeeIt's a formal legal request asking the court to reschedule your hearing to a later date. When filed by an attorney with a valid reason (good cause), courts routinely grant them. The motion is filed through NC eCourts and becomes part of your case record.
Common valid reasons include medical appointments or illness, work or travel conflicts, childcare emergencies, needing more time to prepare your defense, or a scheduling conflict with your attorney. Attorney Barker will review your reason and advise before filing.
Yes — courts have discretion. Prior continuances on the same case, weak justification, or the nature of the charge can all affect the outcome. If denied, Attorney Barker will advise on next steps. The $350 fee covers the filing; outcomes cannot be guaranteed.
The sooner the better — ideally at least 48–72 hours before your court date. We can sometimes file same-day, but it is not guaranteed. Contact us immediately if your date is imminent.
You do not need to appear to file the motion. If the continuance is granted, you will need to appear at the new date. Attorney Barker will represent you at the original hearing if needed — contact us to discuss.
